The long saga of the People vs. the Government establishment has now become a clear picture of a coordinated conspiracy to defraud the people and deprive them of their God-given constitutional rights, by lawyers, lobbyists, and government officials.

The Lawrence County Commission and State’s Attorney Brenda Harvey, McPherson County State’s Attorney Austin Hoffman and Auditor Lindley Howard, Sarah Frankenstein, Deputy Secretary of State Tom Diedrick, SD Association of County Commissioners, South Dakota Municipal League, South Dakota Retailers Association, Rebecca Reimer, David Wheeler, Casey Crabtree, Kristen Conzet (appointed by Noem with 17 days left of the session) are all known to have been part of the hog-housed vehicle bill HB1140. These people are NOT our friends, rather, they are enemies of the constitution and the citizens of South Dakota.

Lawrence, McPherson, McCook, Hamlin, Charles Mix, Butte, and Brule Counties all violated South Dakota Constitution Article 3 Section 1Article 6 Section 4 and Section 26, U.S. Constitution 1st and 14th amendments along with SDCL 12-18A-13 at the urging of lawyer Sarah Frankenstein. They also usurped the duties of the judicial branch by giving themselves the authority to determine the legality of the petitions, which is yet again, another unconstitutional act by the executive branch of the county government.

What part of “shall not be infringed” do they not understand?


42 U.S. Code § 1983 – Civil action for deprivation of rights U.S. Code Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer’s judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable.

42 U.S. Code § 1985 – Conspiracy to interfere with civil rights (3)Depriving persons of rights or privileges

If two or more persons in any State or Territory conspire … for the purpose of depriving, either directly or indirectly, any person or class of persons of the equal protection of the laws, or of equal privileges and immunities under the laws; or for the purpose of preventing or hindering the constituted authorities of any State or Territory from giving or securing to all persons within such State or Territory the equal protection of the laws;……..if one or more persons engaged therein do, or cause to be done, any act in furtherance of the object of such conspiracy, whereby another is injured in his person or property, or deprived of having and exercising any right or privilege of a citizen of the United States, the party so injured or deprived may have an action for the recovery of damages occasioned by such injury or deprivation, against any one or more of the conspirators.


The conspiracy to defraud the people and intent to deprive them of their constitutionally protected rights is obvious. If we weren’t so lacking in legal representation in this state, the citizens would have a heck of a class action lawsuit!

Are you asking yourselves why are these officials who swore an oath to uphold the constitution so willing to break the law and stomp on the rights of the citizens?

Why are the lawyers and lobbyists so hellbent on keeping the ES&S computerized vote counting machines and preventing transparent elections under the local control of the residents of the precinct?

There must be quite a motivating force, and it isn’t the best interests of the People.

This is a good reminder for us as we go into the 2025 legislative session. We need people to be there in Pierre, testify in committee hearings, watch the bills dropped on a daily basis, and keep your eyes and ears open for all the shady back room dealings that go on in the state capitol.

In the show, Rick details several counties who were not compliant with state law in having all voter histories uploaded by December 15th. Yankton County is missing 44% of the voters who voted on November 5th. Since Yankton is a voter center county, uses the E-poll books and the live, real-time, data monitoring E-Pulse system, how in the world could they be missing 44% of their voter histories 45 days after the election since the data is supposed to be updated instantly?

Rick has monitored for compliance for multiple years now, and in each case, there are counties who fail to tie all their votes to a voter by the deadline. Rick then promptly notifies the county auditor and cc’s the Secretary of State. The question is, why isn’t Monae Johnson’s office doing this?
