HB1052 which would provide Constitutional certainty to the people of South Dakota and answer the cries of the people who have faced condemnation on their land by eliminating eminent domain for carbon pipelines.
The bill passed 10-3 in committee with Healy, Reisch, & Jamison voting in opposition and sending a message to the people that they feel it’s appropriate for a private carbon pipeline to forcibly go on land where they are not welcome.
The people have spoken on this issue. The SD Supreme Court has ruled on this issue. And now it’s time for the legislature to act.
This does not stop any project from happening. It simply allows for fair negotiations between a company and landowners. “No thank you,” is a full sentence.
